General Terms

Welcome to the Mobility Recliners Ltd – T/A Recliners Direct catalogue and website terms and conditions for use. These apply to the use of the Mobility Recliners Ltd catalogue and/or website, and by accessing these and/or placing an order through the Head Office Distance Sales Department, you agree to be bound by the Terms and Conditions set out below.

This site is owned and operated by Mobility Recliners Limited (“MRL, RD, we, our, us”). Registered office: CT Jones & Co. 27, Barnfield House, Accrington Rd, Blackburn BB1 3NY. Amendments

We aim to constantly improve and develop the RD website and catalogue for the benefit of all our customers, to allow this process to take place, we may occasionally:

  • Modify or withdraw, temporarily or permanently, this Website (or any part of it) with or without notice; and/or
  • Change the Conditions from time to time, and your continued use of the Website (or any part of it) following such change will demonstrate your acceptance of such change. Alter or extend promotions at any time.

If RD is informed of any inaccuracies in the material on the Website, we will attempt to correct them as soon as we reasonably can.

Accuracy of content

RD has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described.

We make every effort to display the colour of the furniture as accurately as possible. But as colour reproduction depends on your computer’s monitor, we cannot guarantee that your monitor’s display of the colour is accurate to the actual product. To help ensure that you purchase the chair or sofa colour of your choice, selected colour swatches are available on request.

Whilst every care is taken to ensure the information in this publication is correct, no legal responsibility can be accepted for any inaccuracy. The company reserves the right to alter or modify the information contained herein at any time in light of technical or other developments.

Placing your Order

When placing your order, we ask you carefully read our online product details and descriptions. All dimensions provide are approximate and supplied by the manufacturers. As products are handmade, there will inevitably be slight variations in dimensions. Our online product pages provide information of our services in detail, giving you as much information as possible, including operation, maintenance and care information.

Details of all items, including fabrics, colours, size have been thoroughly checked, verified and you will be asked  to confirm you have read and understand our Terms and Conditions before completing an online sale – and a confirmation email of the order confirming all the details will be provided to you on completion of a purchase.

In giving this confirmation you agree that the order and its contents are correct and you are happy with your product. Although we understand the difficulties in checking access routes, (door sizes, corridors, etc.), for installation of furniture, it is always your final responsibility to ensure that your furniture will fit into your home.

Prices

All prices shown are in sterling. Due to circumstances beyond our control, prices may have to be altered up or down, including any alterations to the rate of Value Added Tax.

VAT Free

If you are chronically ill or disabled and the product(s) you are ordering are denoted ‘VAT free’, you may be eligible for the VAT free price. To qualify you MUST complete and sign the Eligibility Declaration.

Please note there are penalties for making false declarations; if you are in any doubt as to whether you are eligible to receive goods or services zero-rated for VAT, you should consult H. M. Revenue & Customs Notice 701/7 VAT Reliefs for Disabled People or contact the VAT National Advice Service on 0300 123 1073 before signing the declaration.

Payment

Payment methods include cash (in store only), cheque (Please note, cheques will need an extra 5-7 days to clear before delivery can be made), debit or credit card (Visa, MasterCard or Switch/Maestro). Payments can also be made electronically by bank transfer; details will be provided on request.

Payment in full is required at the point of order for all 48-Hour / express delivery items, 7-14 day delivery items, internet orders placed in-store, orders of bespoke furniture ranges, showroom ex-display stock and factory outlet stock.

For all other products, a minimum deposit of 30% or £100 (whichever is the greater), is required, with the full balance being required when your goods have been manufactured and pre-delivery.

All orders must be paid in full when goods have been manufactured and prior to delivery. Goods will remain the property of RD until such a time as payment has been made in full. Please allow for longer delivery times during Easter, Spring Bank and Christmas periods due to factory holidays.

On the day of delivery, it is your responsibility to ensure that the delivery team can gain easy access to the room that the furniture is going into and that the area you want the furniture placed in is cleared.

With the optional installation delivery service, the delivery team will unpack your furniture, install it in the room of your choice and, if you wish, remove all packing materials from your home and recycle wherever possible. On an Express and/or 1-man delivery service, delivery will be to your door only.

To make sure you are completely satisfied with your items, the delivery team will ask you to sign for receipt of your furniture after it has been installed.

Responsible Disposal

Upon delivery of your new RD furniture, if arranged pre-delivery, any old furniture, on a like-for-like basis, can be taken away and, where possible, will be recycled. This service is hassle-free and eco-friendly. This service is only available when the installation delivery option has been selected. There is a small surcharge of £35 per item to remove old furniture on a like-for-like basis.

Please note; Old furniture cannot be return when removal has taken place. Our responsible disposal service is available in Mainland UK only.

Cancellation

Since manufactured to your order, cancellation or amendment of an in-store order outside of any applicable Cooling Off period will incur a cancellation charge of 30% of order value (or £100 if greater) for standard furniture ranges and 100% of order value for bespoke furniture ranges, showroom ex-display stock and factory outlet stock.

Cancellations and returns of in-store orders after delivery will only be accepted on the grounds of product fault or damage arising pre-delivery.

Although our products are designed for posture and comfort, we cannot accept cancellation for a product no longer being appropriate for your needs as a consequence of changes in your circumstance or any deterioration in health arising after an order has been placed.

Where orders of standard furniture ranges are cancelled under distance sales regulations, the cancellation charge will not be applied. Please refer to the “Distance Selling” section for further information around processes and costs associated.

Refunds and Replacement

Should you receive goods that are faulty or damaged you are entitled to a full refund or replacement up to 30 days from the date of receipt. Please note that RD reserves the right to examine the goods to confirm damage and establish fault prior to agreement of a refund or replacement. On the day of delivery, you will be asked to sign to confirm receipt of goods in full.

Please note that if you contact us more than 6 months following the date of your purchase, you will be required to prove that the fault has occurred as a result of a manufacturing issue.

If you wish to make a claim outside the guarantee period set out below, you can contact us to discuss options for repair or replacement of your goods.

Distance Selling

The following applies only to orders of standard furniture ranges placed online, in-store, by mail order or by telephone, where items have not been inspected in one of our retail stores.

Orders considered to fall under the Information, Cancellation and Additional Charges (ICAC regulations), i.e. distance sales contracts, are subject to a 14-day return or exchange right. Where the 14th day falls on a Saturday, Sunday or Bank Holiday the final day shall be deemed to be the following working day. This must be requested in writing in the period immediately following the delivery date.

In recognition that you have not had the benefit of seeing the furniture in one of our stores prior to purchase, this period is to give you the opportunity to inspect the goods and correct any wrong choices that may have been made.

Until returned to RD, the furniture remains under your ownership and it will be your responsibility to maintain and protect it from damage, keeping it in “as new” condition. Failure to return goods in perfect condition may entitle RD to make a claim for damages.

Due to their intimate nature, all mattresses will be delivered sealed in clear plastic wrapping that will allow for inspection. Any mattresses that have been unsealed will be deemed as having been used and therefore cannot be returned for any reason other than where found to be faulty or purchased under distance sales regulations.

Swivel Chairs cannot be returned once assembled, as by nature that cannot be disassembled and reassembled safely and securely. Swivel chairs can only be returned as unsuitable in unopened sealed boxes.

It is the customers responsibility to return cancelled orders to our showroom. Returned items must be safely and securely packaged to avoid transit damage. Any products that arrive back to us damaged or not safely and securely packaged will be refused and returned to the customer.

Your Guarantee

RD is committed to ensuring that everything we sell is of the highest quality. We offer a 1 year guarantee on everything we supply and on products that we have exclusively sourced from our supplier partners. Our standard guarantee rises to 5 years on British Made ‘Sherborne’ and ‘Celebrity’ electrically-adjustable chairs and beds*

For any showroom ex-display stock, factory outlet stock or other goods sold “as seen”, our guarantee will cover only the mechanical movement and motor for an electrically adjustable chair for a 1-year period. RD will honour all repairs free of charge within the first year.

Your guarantee starts from the date of delivery and offers cover against manufacturing defects on the construction of the frame and frame springs. It also covers your items against any defects which may arise, under normal use, through faulty factory workmanship, including recliners.

Products bought with Staingard Protection are also protected for 5 years against everyday spills and stains (for more details, please see in store or contact 01772 513115 or Staingard directly on 08700 174040).

Warranty Issues   

As we supply recliners manufactured by a wide range of companies, the length of the warranties varies a great deal. However, all our products come with a minimum of 12 month’s warranty. If your purchase has a longer warranty than 12 months all parts are covered for the duration of the warranty, however after the first 1-year period the manufacturers will likely charge you a call-out fee.

These are as follows and are not exhaustive. Most companies charge £45+Vat. If your purchase develops a problem during the warranty period please send a picture of the problem along with your original order number as proof of purchase from us and the original delivery address to: mobilityrecliners@gmail.com

Please note that your guarantee does not cover normal wear and tear.

It is important to note that we often find that damage can be avoided by correct care and maintenance. Our guarantee excludes instances where damage is as a result of lack of care, insufficient daily maintenance, incorrect cleaning, change of specification by the customer or usage outside of the manufacturer’s guidelines.

This guarantee applies to Mainland UK only.

Health & Safety (Electric/Riser Recliners Chairs & Swivel Recliners) When using the chair in the lift or recline positions ensure that children and pets are kept away from the chair. The chair will stop automatically if you remove your fingers from the controller. To avoid accidents with children and pets whilst the chair is unsupervised, we recommend that the power supply be disconnected when the chair is not in use.

Where applicable remove the safety key/switch from the handset when the chair is not in use. When the footrest of a chair is raised ensure that no unnecessary downward force is applied, to prevent the chair tipping forward or damage to the scissor action. Always keep the chairs away from the wall to avoid damage to the motors. We recommend all electrics be switched off at the mains if not in use.

As swivel recliners are delivered in modular form and require assembly by the customer, it is the customer’s responsibility to ensure correct assembly. We recommend that the bolts are checked monthly to ensure all the bolts on moving parts are tightened fully. This is the customer’s responsibility, even if the chair arrives assembled.

Cleaning

Always follow your manufacturer’s cleaning and care label instructions. Clean your upholstery at least once a year and before soiling becomes ingrained. Clean all parts of the furniture together as slight color changes can sometimes occur. We cannot be held responsible for use of non-recommended cleaning solutions.

Exclusion of Liability

Nothing in these terms shall limit or exclude in any way our liability for death or personal injury caused by our negligence or the negligence of our employees, agents or suppliers, fraud or fraudulent misrepresentation, any breach of the obligations implied by law or any other matter for which it would be illegal or unlawful for us to exclude or attempt to exclude our liability.

Subject to the above, we shall not be responsible for any losses that you suffer as a result of our failure to comply with the contract between us, except for those losses which are a foreseeable consequence of that failure and which are limited to the price of the goods you have purchased.

We shall not be liable under or in connection with the contract between us for loss of income or revenue (including but not limited to wages), loss of business, loss of anticipated savings, or loss of data (in each case whether the loss is direct, indirect or consequential). However nothing in this paragraph shall prevent claims for damage to your physical property, excluding the cost of repairing any pre-existing faults or damage to your property that we discover in the course of delivery.

We shall not be liable to you or responsible for losses or damage incurred by you which arise as a result of you providing to us incorrect measurements, plans, specifications, choices or details, or failure by you to take account of the features, size and shape of the space in which you wish to place the goods.

Business use

Most of our items are suitable for general domestic use only. (We also offer a range of mobility chairs and adjustable beds specially designed for NHS and Care Home use, as these products are classed as Medical Aids rather than general domestic furniture. Contact our team for more details if you require this sort of product).

If you are planning to use any product for business purposes please make sure that you are covered by the appropriate insurance. Where you decide to use the products in the course of a business, we exclude (to the fullest extent permitted by law) those warranties and conditions relating to fitness for a particular purpose.

Our maximum liability to business users, arising out of, or in connection with, the products shall be limited to the replacement value of the product in question (except in the case of death or personal injury caused by our negligence or in respect of fraud).

In relation to business users, we do not accept liability for the fitness of goods for business purposes, nor do we accept liability for neither loss of use of the item nor any loss over and above the cost of the item in the event of a claim for breach of warranty or condition.

For commercial use, we do not accept any responsibility or liability for safety standards or compliance unless you have requested, in writing, furniture for use in that environment and we have supplied relevant safety certification.

Damage to your computer

RD makes every effort to ensure that this website is free from viruses or defects. However, due to the nature of the Internet, we cannot guarantee that your use of this website won’t affect your computer.

RD recommends that you purchase the right firewall and antivirus software to use this and other websites and screen out anything that may damage it. MRL shall not be liable in the very unlikely event that while using this website your computer equipment is damaged.

Events outside our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under our contract with you that is caused by events outside our reasonable control (“Force Majeure Event”).

A Force Majeure event includes any act, event, non-occurrence, omission or accident beyond our reasonable control and includes, in particular (without limitation), failure of energy sources or transport network, acts of God, war, terrorism, riot, civil commotion, interference by civil or military authorities, national or international calamity, armed conflict, malicious damage, breakdown of plant or machinery, nuclear, chemical or biological contamination, sonic boom, explosions, collapse of building structures, fires, floods, storms, earthquakes, loss at sea, epidemics or similar events, natural disasters or extreme adverse weather conditions, or default of suppliers or subcontractors.

Our obligations under the contract between us are suspended for the period that the Force Majeure Event continues, and we will have an extension of time to perform these obligations for the duration of that period. We will take reasonable steps to bring the Force Majeure event to a close or to find a solution by which our obligations under these Terms can be performed despite the Force Majeure Event.

Law

Whilst every care is taken to ensure the information in this publication is correct, no legal responsibility can be accepted for any inaccuracy. The company reserves the right to alter or modify the information contained herein at any time in light of technical or other developments.

The laws of England shall govern the contract between us and any dispute between us will be resolved exclusively in the courts of England. English is the only language offered for the conclusion of the contract.

The parties to the contract are RD and you, the customer placing an order with us. You may not assign or sub-contract any of your rights or obligations under these terms and conditions or any related order for products to any third party.

If any portion of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these terms and conditions shall not be affected.

Delivery and Installation

Delivery is usually free on all products, however we also offer an In-Home installation service for a small charge of just £75.  All our products are available with the option of the installation service. This service is available in Mainland UK only. Delivery lead times are dependent on the product type and stock status. Please allow for longer delivery times during the Easter, Spring Bank and Christmas periods due to factory holidays.

We recommend that you do not dispose of your existing recliner or furniture until one day prior to your confirmed delivery date. Please notify us before delivery if you require removal of old furniture. Please note; we are unable to return items that have been removed from customers home.

Purchase of Additional Items

If you are thinking of purchasing extra items, such as a footstool or chair, at a later date, there may be slight colour or shade variants. It is therefore recommended to order all furniture requirements at the same time. (5 year guarantee covers mechanism & motor and can vary across models).

Changed your Mind?

If you place an order with RD by post, telephone or online, should you wish to cancel your order you have the right to do so without giving a reason. This cancellation period will expire after 14 days after your receipt of the goods, so you must inform us within this period of your wish to cancel. To exercise the right to cancel, we can be informed of your decision by phone, by email, or by post.
